Welcome to the official website of the JohnKessler4Conroe campaign (“Campaign”). By accessing or using this website, including any content, features, forms, donation pages, email sign-up tools, text update features, or other services made available through the Site (collectively, the “Site”), you agree to be bound by these Terms of Use. If you do not agree to these Terms, please do not use this Site.

1. Purpose of This Site

This Site exists to inform, engage, and communicate with voters, supporters, volunteers, and members of the public regarding the Campaign of JohnKessler4Conroe. It may include campaign updates, policy, positions, event information, volunteer opportunities, contribution tools, contact forms, and other campaign-related materials.

2. Use of This Site

You may use this Site only for lawful purposes and in a manner consistent with these Terms of Use. By using this Site, you agree not to:

• Violate any applicable federal, state, or local law or regulation;
• Interfere with the operation, security, or functionality of the Site;
• Attempt to gain unauthorized access to any part of the Site, its servers, or related systems;
• Use bots, scrapers, automated tools, or similar methods to extract data or content from the Site without written permission from Campaign;
• Upload, transmit, or distribute malicious code, spam, or harmful material;
• Impersonate the Campaign, its representatives, volunteers, supporters, or any other person or entity;
• Use the Site in any manner that is abusive, threatening, defamatory, fraudulent, or otherwise improper.

We reserve the right to restrict or terminate access to the Site for any user who violates these Terms or misuses the Site.

3. Political Nature of This Website

This Site is operated for political campaign purposes. It is intended as an official campaign communication of JohnKessler4Conroe and should be understood as such by all visitors. Any political advertising disclaimer required by applicable law shall appear where appropriate on the Site or in related campaign communications.

4. No Government Affiliation

This Site is a private campaign website. It is not an official website of the City of Conroe, Texas, or any governmental agency, office, or department. Nothing on this Site should be interpreted as an official government statement, notice, policy, service, or public record.

5. Information and No Professional Advice

The content on this Site is provided for general informational and Campaign purposes only. Nothing on this Site constitutes legal advice, tax advice, financial advice, or other professional advice of any kind. Visitors should consult the appropriate official sources, advisors, or authorities for election procedures, legal obligations, tax matters, and other formal guidance.

6. User Submissions

If you submit information to the Campaign through this Site, including through contact forms, volunteer forms, event registrations, surveys, or other submissions, you represent that the information provided is accurate and complete. By submitting information through the Site, you authorize the Campaign to use that information for lawful Campaign, administrative, compliance, communication, and recordkeeping purposes, subject to applicable law and the Campaign’s Privacy Policy.

We reserve the right to refuse, remove, or disregard any submission at our discretion.

7. Contributions and Donations

If this Site enables campaign contributions, all contributions must comply with applicable law. By making a political contribution through the Site, you represent that:

• Your contribution is made voluntarily.
• The funds contributed are yours to give and are not being provided by another person for the purpose of making the contribution in your name.
• The information you provide is truthful, accurate, and complete.
• The contribution is lawful under all applicable laws and regulations.

The Campaign reserves the right to reject, return, or refund any contribution that appears to be unlawful, inaccurate, incomplete, excessive, suspicious, or otherwise improper.

Campaign contributions are not charitable contributions and are not tax-deductible. 

8. Intellectual Property

All content on this Site, including but not limited to text, graphics, logos, slogans, photographs, videos, design elements, and campaign materials, is owned by or used with permission by the Campaign and is protected by applicable intellectual property laws. You may view, download, or print materials from this Site solely for personal, noncommercial, and lawful use related to learning about or supporting the Campaign, provided that you do not alter the content or remove any copyright, trademark, or attribution notices. Any other use, reproduction, republication, distribution, display, or exploitation of Site content without prior written permission is prohibited.

9. Third-Party Services and Links

This Site may include links to third-party websites, social media platforms, contribution processors, email tools, event services, or other external providers. These third-party services are offered for convenience only. The Campaign does not control and is not responsible for the content, availability, privacy practices, security, or terms of any third-party website or service. Your use of any third-party service is at your own risk and subject to that provider’s own terms and policies.

10. Privacy

Use of this Site is also governed by the Campaign’s Privacy Policy, which describes how personal information may be collected, used, stored, and disclosed. By using the Site, you acknowledge and agree to those practices.

12. No Public Forum; No User Posting Rights

This Site is a private campaign platform and is not a public forum. The Campaign is under no obligation to allow comments, user postings, public discussion, or other interactive features on the Site. If any interactive feature is offered at any time, the Campaign reserves the absolute right to monitor, moderate, remove, restrict, disable, or decline any content or user access for any reason and without notice.

13. Disclaimer of Warranties

This Site is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, the Campaign disclaims all warranties, express or implied, including warranties of accuracy, completeness, merchantability, fitness for a particular purpose, non-infringement, security, and availability. The Campaign does not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

14. Limitation of Liability

To the fullest extent permitted by law, JohnKessler4Conroe, John Kessler, Enrique Diaz (Treasurer), the Campaign officers, volunteers, agents, consultants, contractors, and representatives shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or related to your use of, or inability to use, this Site. To the fullest extent permitted by law, any liability arising from or related to this Site shall be limited to the lesser of $100 or the amount of any contribution you made through the Site during the twelve months preceding the event giving rise to the claim.

15. Indemnification

You agree to defend, indemnify, and hold harmless JohnKessler4Conroe, John Kessler, and Enrique Diaz (Treasurer), the Campaign’s officers, volunteers, agents, consultants, contractors, and representatives from and against any claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to your violation of these Terms or your misuse of the Site.

16. Changes to the Site and Terms

The Campaign reserves the right to update, modify, suspend, restrict, or discontinue this Site or any portion of it at any time and without notice. We may also revise these Terms of Use from time to time. Any changes become effective upon posting to the Site. Your continued use of the Site after revised Terms are posted constitutes your acceptance of those changes.

17. Governing Law and Venue

These Terms of Use shall be governed by and construed in accordance with the laws of the State of Texas, without regard to conflict-of-law principles. Any legal action arising out of or relating to these Terms, or the Site shall be brought exclusively in a court of competent jurisdiction in Montgomery County, Texas, unless applicable law requires otherwise.

18. Severability

If any provision of these Terms of Use is found to be unlawful, invalid, or unenforceable, the remaining provisions shall remain in full force and effect.
